RAZ MEDICAL ID BRACELET TERMS AND CONDITIONS
AND WAIVER OF LIABILITY

This RAZ Medical ID Bracelet Terms and Conditions and Waiver of Liability applies to the RAZ Medical ID Bracelet (the “Bracelet”), and the Platform which contains the End User Content defined below, and which is accessed through the Bracelet. The Bracelet and the Platform are offered by RAZ Mobility, LLC (“RAZ Mobility”) and its partner TapMedID.

Please read these terms and conditions carefully. This is a legally binding agreement. If you are purchasing the RAZ Medical ID Bracelet on behalf of someone else, you represent and warrant that you have the authority to do so and that you can accept and agree to these Terms and Conditions on their behalf.

CONTENT AND DATA

You represent and warrant that you own all right, title, and interest in and to the data, medical information, content, or other materials (“End User Content”) that you provide to RAZ Mobility for the purpose of providing the service related to the RAZ Medical ID Bracelet, including use the of Platform where you enter the End User Content, which is shared with anyone who accesses the information via the Medical ID Bracelet. By uploading the End User Content or allowing RAZ Mobility and its subcontractors to access such End User Content, you hereby grant and will grant RAZ Mobility and its subcontractors a nonexclusive, worldwide, royalty free, fully paid up, transferable, and sublicensable license to use, copy, display, upload, perform, distribute, store, modify, and otherwise use the End User Content for the limited purpose of providing access to the End User Content through the Bracelet.

DISCLAIMER OF WARRANTY

THE BRACELET AND PLATFORM ARE FURNISHED AS IS, WHERE IS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. RAZ MOBILITY MAKES NO REPRESENTATION OR WARRANTY THAT ANY CONTENT DISPLAYED ON THE PLATFORM IS ACCURATE, COMPLETE, OR APPROPRIATE. FURTHER, RAZ MOBILITY MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE BRACELET AND PLATFORM WILL BE UNINTERRUPTED, OR ERROR-FREE, FREE OF VIRUSES, MALICIOUS CODE, OR OTHER HARMFUL COMPONENTS, OR OTHERWISE WILL BE SECURE. RAZ MOBILITY MAKES NO REPRESENTATION OR WARRANTY THAT THE END USER CONTENT WILL BE PRESENTED TO FIRST RESPONDERS, HEALTH CARE PROVIDERS, OR ANYONE ELSE WHO ATTEMPTS TO ACCESS THE END USER CONTENT THROUGH THE BRACELET IN A TIMELY FASHION.

WAIVER OF LIABILITY

IN CONSIDERATION FOR RECEIVING THE BRACELET, YOU RELEASE FROM LIABILITY AND WAIVE YOUR RIGHT TO SUE RAZ MOBILITY AND ITS EMPLOYEES, OFFICERS AND SUBCONTRACTORS (COLLECTIVELY, “PROVIDERS”) FROM ANY AND ALL CLAIMS, INCLUDING THE PROVIDERS’ NEGLIGENCE, RESULTING IN ANY PHYSICAL INJURY, ILLNESS (INCLUDING DEATH) OR ECONOMIC LOSS THAT YOU MAY SUFFER IN CONNECTION WITH THE RAZ MEDICAL ID BRACELET AND ASSOCIATED PLATFORM.

RESTRICTIONS

You will not engage in, attempt to engage in, or permit or assist others in engaging in, any of the following prohibited activities: (i) interact with the Bracelet and Platform in a manner which is fraudulent, libelous, abusive, obscene, profane, harassing, or illegal; (ii) use the Bracelet for any illegal purpose or in violation of any law, statute, rule, permit, ordinance or regulation; (iii) gain or attempt to gain unauthorized access to the Platform; (iv) engage in commercial use or distribution of the Bracelet or Platform, or copy or create any derivative work of the Bracelet or Platform.

REFUND POLICY

If you purchased the Bracelet, and you return the Bracelet within 20-days from the date of purchase, you will receive a full refund of the purchase price on the condition that the Bracelet is in like-new condition. You will be responsible for the cost of shipping the Bracelet to RAZ Mobility.

APPLICABLE LAW

By purchasing the RAZ Emergency Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Maryland, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and RAZ Mobility.
